APPLICANT REQUESTS THAT:
His Date of Birth (DOB) on his DD Form 214, Certificate of
Release or Discharge from Active Duty, be changed from 29 May
50 to 29 May 48.

APPLICANT CONTENDS THAT:
The year of his birth is incorrect on his DD Form 214.
In support of his request, the applicant provides copies of his
original birth certificate and DD Form 214.

STATEMENT OF FACTS:
The applicants DD Form 214 lists his DOB as 29 May 50.
On 7 Jan 13, a letter was sent to the applicant requesting the
original or a certified/notarized copy of his birth certificate.

AIR FORCE EVALUATION:
AFPC/DPSIRP recommends denial. DPSIRP states that the applicant
failed to provide the legal document that is required to change
his DOB. The birth certificate the applicant provided is not an
original or certified copy; therefore, it does not meet the
legal requirements to be used as a source document.
AFI 36-2608, Military Personnel Records System, Table A7, allows
the Air Force to make changes on prior service personnel if the
data in question was recorded in error.
The applicant has failed to provide supporting documentation and
absent such documentation there is no proof his DOB was recorded
in error.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 22 Mar 13, a copy of the Air Force evaluation was forwarded
to the applicant for review and comment within 30 days (Exhibit
D). As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. We note the
applicant was asked to provide an original or a
certified/notarized copy of his birth certificate as required by
the Air Force Instruction to make the change. However, the
applicant has failed to do so. Should the applicant provide the
documentation noted above we would be willing to reconsider his
request. In the absence of such evidence, we find no basis to
recommend the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.
